This agreement sets out the terms for using the YouBOOST services and governs both our digital products or services (“services”) and our users (“customers”). When we refer to “You” within the document, we mean Users or customers. YouBOOST is committed to provide a transparent services irrespective of each customer demands. Please take your time to read this page carefully, for it represents our agreement with you.

1. Introduction

This Terms and Condition (“Agreement”) also includes our Privacy Policy, and cookies policy, and also referred to by those agreements, form a whole, which governs any access to the YouBOOST services, whether you are a visitor, user, or customers. These terms have been created in compliance with the France P2B Regulations, GEO 23/2021 Regulations, and The European Union General Data protection regulations (GDPR).

2. Eligibility for Access

By accessing and using the site, you acknowledge and agree that you are over the age of 18 and are of legal age to form a legally binding contract with us. Please note that access to the site and the Services are not available to users under the age of 18.

3. Order purchase

In full consideration of the service, performance, obligations, and the rights granted herein, the Client agrees to pay YouBOOST the required Fees, as outlined in the order page, for the provision of the Services. You agree that by placing an order for a service via the You-boost.com website, you have read and consent to this terms of service found on this agreement.

4. Service Provision

When you place an order with YouBOOST, you agree to only use the service to promote your Instagram/Twitter/Facebook or any Social media account to help boost your “Online Presence” only. You agree that YouBOOST do NOT guarantee your new followers will interact with you, we simply guarantee only an increase in followers of which you payed for.

You agree not to upload anything that defarmatory into your social media account during the provision of the services including but not limited to nude contents or any material that is not accepted, safe or suitable for the specific Social Media community.

5. Terms Related to Delivery Of Services

You agee to only use the YouBOOST services in compliance with each specific Instagram /Youtube/ Facebook/ Twitter or other social media site Terms of Service page including applicable local or State laws.

The YouBOOST fees available on the site are subject to change at any time without notice including the terms. You are required to always read the updated terms at all times before placing an order. Our payment policy stays in effect in the case of rate changes. We endeavor to always offer the best service delivery and estimation for each order. YouBOOST does not guarantee a particular delivery time for any services purchased by a client. The time delivery provided on the order page is only an estimation and we employ our customers to exercise patience.

6. No Professional Advice; Risk of Use

All services supplied through the YouBOOST site are supposed Digital services and for general guidance and does not constitute professional or non-professional advice. You must consult a professional before making any decisions. None of the information available through the YouBOOST site constitutes a recommendation or solicitation to take or not take any particular action.

The receipt of any questions or feedback you submit to YouBOOST does not create a professional relationship. It does not make any privacy rights other than those described in YouBOOST‘s Privacy Policy.

7. Trademark License

Subject to the express provisions of these terms and conditions. All trademarks, logos, and service marks (“Marks”) displayed on the website are You-Boost.com property. You are not permitted to use these Marks without our prior written consent of YouBOOST.

Unless otherwise specified in these Terms, all Materials, including the Intellectual property in the Services, are our sole property or the property of our licensors. All rights not expressly granted herein are reserved. Except as otherwise required or limited by applicable law, any reproduction, distribution, modification, retransmission, or publication of any copyrighted material is strictly prohibited without the copyright owner’s express written consent.

8. Product Description

YouBOOST try as much as possible to be as accurate as possible and describing each digital products found on the YouBOOST website. However, YouBOOST does not warrant that this Site’s product description or other Content is correct, complete, reliable, current, or error-free. If a digital product offered by us is not as described, your sole remedy is to stop using the service immediately. Terms and Conditions apply.

9. Customer

The Services are available only to individuals (User/Customers) 18 years or above of age and can enter into a legally binding agreement under the french law.

10. Personal Information and Privacy

When you register an account to purchase one of our digital products, we may collect and store some Sensitive PII about you (“personal identification information”). YouBOOST is committed to ensuring that your personal information is protected. If you provide personal information to the YouBOOST website, it will only be used to complete your purchase. Sensitive Personal Information can be defined as

• Phone number
• Web Address
• Your social media channel ID

11. Service Delivery

When a Customer makes a Purchase on the YouBOOST website. Unless otherwise agreed with YouBOOST, we will endeavor to process your order, for delivery within 2-7 days after purchase confirmation. We promise to make necessary arrangements to have the services delivered and fulfilled at the time delivery stipulated on your order page.

YouBOOST also offer a 30 days refill garantee on every order and services, however, we are not obligated to refill every orders, order refill approval shall be to YouBOOST discretion.

The customer agrees that all purchased order delivery fees and processing charges shall be borne by the customer (“Service Fee”). These been said, the service fees, including tax, where applicable, shall be calculated and deducted from your method of payment

12. Restricted Purchase

To comply with licensing and other legislation some products and services on this website are only available to certain categories of customers (such as people aged 18 years and over) (“Restricted services”).  If you find yourself within this category you are advised not to proceed with your purchase for such products except with a parental consent.

13. Intellectual Property Rights

All content available on the website, including, but not limited to, the trademarks, logos, and service marks displayed on the website (collectively, the “Trademarks”) are the registered and unregistered marks of YouBOOST, our affiliates, or licensors in Romania and other countries. All Trademarks not owned by us, our affiliates, that appear on the website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

Except as required under applicable law, neither the services, the Trademarks, nor any other portion of the website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.

14. Aceepatable User Policy (AUP)

You agree not to do any of the following:

• Your use and access of the the YouBOOST website, and services, is entirely at your own initiative and risk. You are solely responsible for compliance with local laws in with regard to the use of such services.
• You shall not use the YouBOOST platform and services for any purposes other than those intended by the YouBOOST and as determined by YouBOOST at its sole discretion.
• You shall not attempt to circumvent any security measure put in place for the YouBOOST platform users or attempt to gain unauthorized access to any services, or computer systems or networks owned and/or controlled by the YouBOOST, through hacking, mining or any other means.
• Infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy;
• Violates, or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability;
• Is fraudulent, false, misleading or deceptive
• Is defamatory, obscene, pornographic, vulgar or offensive;
• Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
• Is violent or threatening or promotes violence or actions that are threatening to any other person;
• Harms minors in any way; or Disseminating unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
• It was transmitting material that encourages conduct that constitutes a criminal offence results in civil liability or otherwise breaches any relevant laws, regulations, or practice code.
• He/she is gaining unauthorized access to other computer systems.
• It is interfering with any other person’s use or enjoyment of the site.
• Breaching any applicable laws;
• Promotes illegal or harmful activities or substances.

You-Boost.com has the right to investigate and prosecute violators to the fullest extent of the law.

15. Disclaimer

Your use of this website and services linked via this portal is at your own risk. You-Boost.com shall not be liable for any direct, indirect, incidental, or consequential damages or loss arising out of your access to or use of this services. YouBOOST will not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with, Use of, or inability to use our Site/Services; or Use of or reliance on any content displayed on our website.

In particular, we will not be liable for:

• Loss of profits, sales, business, or revenue;
• Business interruption;
• Loss of anticipated data;
• Loss of business opportunity, goodwill or reputation; or
• Any indirect or consequential loss or damage

16. Limitation of Liability

You acknowledge and agree that the entire risk arising out of your use of the platform, Services, remains with you to the maximum extent permitted by law. Neither YouBOOST nor any other party involved in creating, producing, or delivering the Services, will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or any damages for personal or bodily injury or emotional distress arising out of or in connection with these Terms.

17. Communications

You (1) consent to receive communications from You-Boost.com in an electronic form such as e-mail to provide exclusive deals and promotions for contractual purposes. (2) Agree that all terms and conditions, agreements, notices, disclosures, and other communications that You-Boost.com provides to you electronically via e-mail satisfy any legal requirement that such communications would satisfy if they were in writing. This subparagraph does not affect your statutory rights.

18. Children’s Privacy Policy

YouBOOST respects the privacy of children, and we are committed to complying with the European Union GDPR Children’s Online Privacy Protection. This site does not knowingly collect, use, or disclose personal information from children under 18 without prior parental consent. However, we may provide our service to children under 18 years of age but under a parental guardian’s supervision.

19. Termination

YouBOOST reserves the right to immediately suspend or terminate its Service to any User without warning and notice for violation or breach of any of the agreement in this Terms of Service.

20. Choice of Law

This terms and the relationship between you and YouBOOST is governed by all French Laws, including the French Data Protection Authority for Personal Data Processing (“RDPA”), the P2B Regulations, GEO 23/2021 Regulations, and the local laws of where you reside, without regard to Its conflict of law provisions. If you think the laws fail to satisfy the law of your jurisdiction, we should like to hear from you. However, ultimately it is your choice as to whether you wish to use our website.

21. Applicable Legal Compliance

You agree to comply with all applicable laws, rules, and regulations, including without limitation all France Laws, including the France Data Protection Authority for Personal Data Processing (“RDPA”), the P2B Regulations, GEO 23/2021 Regulations, and the local laws of where you reside, and your use of the Services. More specifically, but without limitation, you agree to comply with all applicable laws regarding the transmission of technical data exported to or from the country in which you reside. If your country of residence is based within the European Economic Area, the General Data Protection Regulation will govern your privacy concerns as they relate to this TOS and to related documents and amendments as per the YouBOOST Privacy Policy.

For the purposes of European Directive 95/46/EC, the General Data Protection Regulation 2016/679) (“GDPR”) and any applicable national implementing laws in your jurisdiction, and with respect to your personal data, you acknowledge and agree that you are the Controller (as that term is defined in the GDPR), and we are a Processor (as that term is defined in the GDPR) insofar as you may store personal data through your use of our Services only as permitted and subject to the terms of this Agreement. You also acknowledge and agree that you are responsible for complying with all obligations of a data controller under applicable law (including The European Union (GDPR)).

22. Ownership

The YouBOOST Site, Services, and YouBOOST Content and materials are owned and protected with the french copyright, and trademark laws.

23. Miscellaneous

YouBOOST may modify the terms herein contained at any time. Such modifications shall be communicated by e-mail and shall be binding on you. 

• YouBOOST‘s opinion on all issues about interpreting these Terms shall be final and binding on you.
• YouBOOST is subject to existing laws and legal process. Nothing contained in these Terms is in derogation of You-Boost.com‘s right and obligation to comply with the law or governmental, court, and requests of enforcement agencies.
• Suppose any part of these terms is held to be invalid or unenforceable, including, but not limited to, the warranty disclaimers and liability limitations set forth above. In that case, the invalid or unenforceable provision will be superseded by a valid, enforceable provision that most closely matches the original provision’s intent and is nevertheless valid and enforceable. The remainder of these terms shall continue in effect.
• You may not assign any rights or obligations against YouBOOST without You-Boost.com‘s prior written consent. YouBOOST reserves the right to transfer any right or obligation against you upon notice to you. Upon such assignment, the assignee shall be bound by the Terms in the same manner as You-Boost.com, and YouBOOST shall cease to have any liability to you.
• YouBOOST shall not be responsible for any delay or deficiency due to any force majeure events such as natural disasters, acts of terrorism, civil labor strife, labor and transportation strikes.

24. Severability

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable. Then that provision shall not affect the validity and enforceability of the remaining terms.

25. Cancellation by Customer

Customers retain the right to discontinue or request to cancel an order before payment. However we do not accept or entertain any cancellation or refund request after order confirmation.

26. Refund policy

All purchases are final on the YouBOOST website, including but not limited to those related to followers, likes and video package fees, are nonrefundable and will not be prorated at any time.

If you dispute any payment you have made to us for our services (by, for example, initiating a chargeback), we hereby reserve the irrevocable right to:

• Temporarily suspend or permanently terminate your access with us; and/or
• Rescind any or all metrics you purchased from us.
• YouBOOST also reserve the right to recind any followers or likes provided to you via your Instagram/Facebook/Twitter or other social media account.

If you engage in any fraudulent activity through or in relation to the Website or our services (e.g. by purchasing a service using a stolen credit card’s information), we will immediately terminate your account with us; no exceptions.

27. Your feedback

YouBOOST encourage you to share your reviews and feedback with us, and we promise to respect your feedback irrespective of the outcome, for it helps us improve on our services and make us serve you better. By submitting feedback, you are granting us an irrevocable, perpetual, non-exclusive, transferable, fully-paid, worldwide license (with the right to sublicense freely) to use, copy, modify, publicly perform, publicly display, reformat, translate, syndicate, republish, excerpt (in whole or in part) and distribute feedback we receive from you for any purpose, including business, commercial, marketing, advertising, or otherwise.

28. Copyright License

• YouBOOST, together with our licensors, own and control all the copyright and other intellectual property rights in You-Boost.com website and the material on our patient portal.
• All the copyright and other intellectual property rights in the You-Boost.com website and our site’s material are reserved.

29. Jurisdiction-Specific Terms

If you are using our website in france, the following additional terms shall apply. In the event of any conflict between the following additional terms and the provisions of the main body of these Terms, the following terms shall prevail.

• Accepting the Terms: By agreeing to these Terms and accessing or using our Services, you acknowledge that you have read and understood these Terms, the additional terms herein and provide your consent to be bound by these Terms, the Privacy Policy, and all other policies or agreements referred to herein.
